Terms of Service

1. Agreement and definitions

These Terms of Service (“Terms”) govern access to and use of the MapleRent mobile application, website, property-listing services, communications tools, support services and related features (collectively, the “Service”).

“MapleRent,” “we,” “us” and “our” refer to the MapleRent platform. “User” and “you” refer to anyone who accesses or uses the Service. “Owner” includes a landlord, property owner, property manager or other person who advertises or claims authority to advertise a property. “Renter” includes a tenant, prospective tenant or person searching for accommodation.

These Terms form an agreement concerning the Service only. They do not create a lease, tenancy, brokerage, property-management, agency, escrow or payment relationship between MapleRent and any User.

2. Scope of the Service

MapleRent is an online marketplace that helps Users advertise, discover and discuss residential rental properties located in Canada. The Service may allow Users to publish listings, search and save properties, send enquiries, communicate, submit verification information, report concerns and contact support.

MapleRent may add, change, suspend or discontinue features, subject to applicable law.

3. MapleRent’s limited role

MapleRent provides technology and marketplace services only. Unless expressly stated in a separate written agreement, MapleRent is not:

• a landlord, tenant, property owner or property manager;
• a real-estate brokerage, broker, salesperson, representative or agent;
• a party to a lease, tenancy, reservation or rental transaction;
• a bank, lender, insurer, escrow provider, trust account or payment processor;
• a guarantor of identity, ownership, authority, rent, deposits, property condition, availability or performance;
• a legal, financial, tax, immigration, housing or real-estate adviser; or
• responsible for inspecting, managing, maintaining, repairing, licensing or supervising any property.

Users independently decide whether to communicate, inspect a property, apply, sign an agreement, disclose information or transfer money.

4. Canadian properties and international Users

Properties advertised through MapleRent must be located in Canada. Users may access MapleRent from Canada or another country, including when searching for housing before travelling or relocating to Canada.

Users accessing MapleRent from outside Canada are responsible for complying with laws applicable in their location. Any tenancy remains subject to the mandatory laws of the Canadian province or territory where the property is located.

5. Eligibility

You must be at least 18 years old and have legal capacity to enter into a binding agreement. By using MapleRent, you represent that your information is accurate, you have authority to accept these Terms, you will use the Service lawfully and you are not prohibited from using it.

MapleRent may request evidence of identity, age, authority or other information where reasonably necessary for verification, safety, fraud prevention or legal compliance.

6. Accounts and security

You must provide accurate, current and complete account information and keep it updated. You are responsible for protecting your password, authentication credentials and devices.

• Do not share, sell, rent or transfer your account.
• Do not create an account using false or misleading information.
• Do not impersonate another person or organization.
• Promptly notify MapleRent if you suspect unauthorized access or misuse.

MapleRent may temporarily restrict an account while investigating suspected fraud, unauthorized access, safety concerns or violations of these Terms.

7. Owner and listing responsibilities

By creating or managing a listing, an Owner represents and warrants that they:

1. own the property or have current, lawful and documented authority to advertise and rent it;
2. have obtained all permissions, licences, registrations and approvals required by law;
3. accurately describe the property, location, availability, rent, deposits, fees, utilities, amenities, restrictions and material conditions;
4. do not omit information that makes the listing materially false or misleading;
5. promptly update or remove an inaccurate or unavailable listing;
6. use only photographs, documents and content they are authorized to use;
7. comply with residential-tenancy, human-rights, privacy, consumer-protection, safety, zoning, licensing and anti-discrimination laws;
8. do not request an unlawful rent, deposit, fee or charge;
9. do not advertise a fictitious, unsafe, unlawful or unavailable property; and
10. honour lawful commitments made to a prospective or actual tenant.

Owners remain solely responsible for their properties, listings, screening, communications, leases, deposits, rent collection, receipts, repairs, maintenance, taxes, insurance and legal compliance.

8. Renter responsibilities and due diligence

Renters are responsible for conducting reasonable due diligence before signing an agreement, providing sensitive information or transferring money.

Before making a commitment or payment, a Renter should independently verify the identity and authority of the Owner, the property’s existence and availability, the proposed lease, the legality of requested amounts, the intended recipient and the provincial or territorial rules governing the property.

Renters should inspect the property personally or through a trusted representative where reasonably possible and obtain independent legal or professional advice when appropriate.

9. Verification and trust indicators

MapleRent may display labels such as “verified,” “reviewed” or “approved.” A label means only that MapleRent performed the specific administrative review associated with that feature at the time of review.

A review is not a guarantee of identity, ownership, authority, property condition, safety, legal compliance, listing accuracy, availability, absence of fraud, creditworthiness or contractual performance.

Documents may be forged, outdated, incomplete, inaccurate or later revoked. Users must continue to perform their own checks. MapleRent may remove, suspend or change a verification status at any time.

10. Payments, rent, deposits and other transfers

Users make payments independently and directly to one another or through a third-party service they select. MapleRent is not a party to those payment arrangements.

MapleRent will not instruct a User to send rent or a deposit to a MapleRent bank account, gift card, cryptocurrency wallet or personal payment address. A person claiming otherwise may be attempting fraud.

Before sending money, a User is responsible for confirming the recipient’s identity and authority, the property’s existence and availability, the legitimacy of the proposed rental, the written agreement, the lawfulness of the amount and the accuracy of the payment destination.

To the maximum extent permitted by law, MapleRent is not responsible for money sent to an incorrect, unauthorized or fraudulent recipient; mistaken, duplicate, delayed or failed payments; payment-provider charges, reversals or chargebacks; cash, wire-transfer, gift-card or cryptocurrency losses; failure to provide possession; failure to pay rent; refund or collection disputes; forged documents; impersonation; or inability to recover transferred funds.

A User who suspects fraud should promptly contact their financial institution or payment provider and, where appropriate, law enforcement, the Canadian Anti-Fraud Centre or another relevant authority. MapleRent may cooperate with lawful investigations but does not guarantee recovery of money.

11. Leases and residential-tenancy laws

MapleRent does not create a tenancy and does not determine the legal rights or obligations of Owners and Renters. A tenancy exists only between the parties who enter into it.

Residential-tenancy rules vary by province and territory. Users are responsible for ensuring that listings, applications, screening, deposits, leases, notices, rent increases, entry, repairs, maintenance, termination and eviction comply with the mandatory laws where the property is located.

Nothing in these Terms excludes, replaces or limits a right or remedy that cannot lawfully be excluded. If these Terms conflict with a mandatory legal requirement, that requirement applies to the extent of the conflict.

12. Communications between Users

MapleRent may enable messages and enquiries. MapleRent does not guarantee that a User will respond or that information communicated by a User is accurate.

Users must not send threats, harassment, discriminatory content, spam, malware, deceptive messages, unlawful payment requests, false documents, unnecessary sensitive information or content that violates another person’s rights.

MapleRent may investigate reported communications and preserve or disclose information where reasonably necessary to protect Users, enforce these Terms, comply with law or respond to a lawful request.

13. Prohibited conduct

You must not use MapleRent to advertise without authority; create a false, duplicate, deceptive or bait-and-switch listing; misrepresent rent, fees, location, condition or availability; conceal material defects; discriminate unlawfully; obtain money or information through fraud; impersonate another person; evade restrictions; scrape data without permission; interfere with security; upload malware; infringe rights; engage in unlawful rental activity; pressure another User to pay immediately; or use the Service for a purpose unrelated to lawful residential rentals in Canada.

14. Human rights and non-discrimination

Users must comply with applicable federal, provincial and territorial human-rights laws. A User must not publish a listing, impose a condition, screen an applicant or communicate in a manner that unlawfully discriminates based on a protected characteristic.

MapleRent may remove discriminatory content or restrict an account where we reasonably believe a violation has occurred.

15. User Content

“User Content” includes listings, photographs, descriptions, messages, documents, reports, reviews and other materials submitted through the Service.

You retain ownership of User Content. By submitting it, you grant MapleRent a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, format, adapt, display and distribute it as reasonably necessary to operate, secure, moderate, improve and promote the Service.

This licence may continue where retention is reasonably necessary for backups, fraud prevention, support, legal compliance, investigations, audit records, dispute resolution, enforcement or content already shared with another User.

You represent that you own or have permission to submit your User Content and that it does not violate law, contract or third-party rights.

16. Moderation, reporting and enforcement

MapleRent may, but is not obligated to, review accounts, listings, documents, reports and communications. The presence of content does not mean MapleRent endorses or guarantees it.

MapleRent may remove content, limit communications, suspend features, restrict an account or terminate access where we reasonably believe these Terms or law have been violated, content is misleading or harmful, a safety or fraud risk exists, another person’s rights may be affected, or action is required by a lawful authority.

MapleRent is not responsible for failing to identify or remove unlawful, inaccurate, fraudulent or harmful content before a User encounters it.

17. Screening and personal information

Unless MapleRent expressly identifies a particular screening service, MapleRent does not conduct credit checks, criminal-record checks, employment verification, reference checks or tenant screening.

Owners are responsible for any lawful screening they choose to conduct. Users must comply with applicable privacy, consumer-reporting, human-rights and residential-tenancy laws and must not collect, use or disclose another person’s information unlawfully.

18. Privacy

MapleRent’s collection, use, storage, protection and disclosure of personal information are described in the MapleRent Privacy Policy, which forms part of these Terms.

Information may be processed for account administration, listings, enquiries, communications, verification, support, fraud prevention, security, legal compliance and other purposes described in the Privacy Policy.

Do not submit personal information that is unnecessary for the legitimate purpose of the feature being used.

19. Third-party services

The Service may contain links to or integrate with mapping, email, hosting, analytics, identity-verification, app-store or payment services. MapleRent does not control and is not responsible for a third party’s availability, security, fees, accuracy, conduct, terms or privacy practices. Separate terms may apply.

20. Intellectual property

The MapleRent name, branding, application, software, interfaces, designs, databases and proprietary materials are owned by or licensed to MapleRent and protected by law.

MapleRent grants you a limited, personal, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose. Except where law permits, you must not copy, modify, distribute, sell, reverse engineer, remove proprietary notices, misuse MapleRent branding or create a competing database from MapleRent content.

21. Service availability and changes

MapleRent does not guarantee that the Service will always be uninterrupted, secure, available or error-free. MapleRent may perform maintenance, correct errors, impose reasonable limits, suspend functionality or discontinue part or all of the Service.

22. Suspension, termination and account deletion

You may stop using MapleRent at any time and may request account deletion, subject to legitimate retention requirements described in the Privacy Policy or required by law.

MapleRent may restrict, suspend or terminate access where we reasonably believe these Terms were violated; information is false or misleading; an account creates a safety, fraud, security or legal risk; a User is abusing another person or the Service; action is required by law; or continued access may cause harm.

Termination does not eliminate rights, obligations or liabilities that arose before termination. Provisions that by their nature should survive will remain in effect.

23. Disputes between Users

MapleRent is not responsible for resolving disputes between Users concerning property condition, availability, rent, deposits, refunds, screening, possession, damage, repairs, communications, lease terms, misrepresentation or performance.

Users are responsible for resolving disputes directly and using the appropriate provincial or territorial tribunal, court, regulator, law-enforcement agency or dispute-resolution process where necessary.

MapleRent may voluntarily provide information or assistance but has no obligation to mediate, adjudicate, compensate, enforce an agreement or recover funds.

24. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. MapleRent disclaims all representations, warranties and conditions, express, implied, statutory or collateral, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability and security.

MapleRent does not warrant that a listing is accurate, lawful, safe, genuine or available; a User is who they claim to be; an Owner has authority to rent; a Renter will pay; verification will detect all fraud; a transaction will succeed; a property will meet expectations; a payment will be safe or recoverable; or the Service will be uninterrupted.

Where exclusions are not permitted, they apply only to the extent allowed by law.

25. Limitation of liability

To the maximum extent permitted by law, MapleRent and its personnel, contractors, affiliates, licensors and service providers will not be liable for indirect, incidental, consequential, special, exemplary or punitive loss, including lost rent, deposits, money, profits, housing, relocation or temporary-accommodation costs, property damage, information loss, reputational harm, emotional distress, data loss or business interruption.

To the maximum extent permitted by law, MapleRent is not liable for loss arising from a User, listing, property, off-platform payment, lease, verification status, communication, third-party service, fraudulent act, impersonation, unauthorized account access, content removal or interruption of the Service.

Where MapleRent cannot lawfully exclude liability, its aggregate liability arising from the Service will be limited to the greater of the amount paid directly to MapleRent during the 12 months before the event giving rise to the claim and CAD $100.

Nothing in these Terms excludes liability that applicable law does not permit MapleRent to exclude or limit.

26. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless MapleRent and its personnel, contractors, affiliates and service providers from claims, losses, liabilities, penalties, damages and reasonable legal costs arising from your breach of these Terms; your listing, User Content, communications or payments; a property you own, manage, advertise or occupy; a lease or arrangement with another User; violation of law or another person’s rights; or your fraud, negligence or wilful misconduct.

This provision does not apply where indemnification is prohibited by law.

27. Electronic communications and acceptance

You agree that MapleRent may provide agreements, notices, disclosures, support responses and other communications electronically through the Service or the email address associated with your account.

Electronic acceptance has the same effect as signing a written agreement, subject to applicable law. MapleRent may record the accepted document version, date and time, User account, platform, application version, IP address and User agent as evidence of acceptance and for security and legal compliance.

28. Amendments and versions

MapleRent may amend these Terms to reflect changes to the Service, legal or regulatory requirements, security risks, fraud-prevention measures, new functionality or business operations.

Each published version will display a version number and effective date. MapleRent may notify Users of material changes and may require acceptance of a new version before continued use of some or all features. Updated Terms apply from their stated effective date and do not apply retroactively unless required by law or expressly agreed.

29. Governing law and jurisdiction

These Terms and disputes arising directly between a User and MapleRent concerning the Service, an account, a listing, platform access or MapleRent’s conduct are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to mandatory consumer rights and any jurisdiction that cannot lawfully be excluded, disputes directly between a User and MapleRent may be brought before the courts of Ontario having jurisdiction.

This section does not determine the law applicable to a rental property, lease, tenancy, rent payment, deposit, eviction, repair, maintenance obligation or dispute between Users. Those matters are governed by the mandatory laws, tribunals and courts of the Canadian province or territory where the property is located.

Nothing in these Terms limits a consumer, residential-tenancy, privacy, human-rights or other legal right that cannot lawfully be waived.

30. General provisions

If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue in effect. MapleRent’s failure to enforce a provision is not a waiver.

You may not transfer your rights or obligations without MapleRent’s written consent. MapleRent may assign these Terms in connection with an incorporation, reorganization, financing, merger, transfer of assets or sale of the Service, subject to law.

These Terms, the Privacy Policy and any feature-specific terms presented to you constitute the entire agreement concerning the Service. Headings are for convenience only.
